These Terms & Conditions govern your access to and use of gripforyou.com and any related websites, online stores, social media pages, products, custom-order services, communications and other services operated by Grip For You (collectively, the “Services”). Throughout these Terms, “Grip For You,” “we,” “us” and “our” refer to Grip For You, while “you” and “your” refer to any person accessing the Services or purchasing products from us.

By visiting our website, purchasing a product, submitting a custom order, providing information to us or otherwise using the Services, you agree to these Terms & Conditions and any policies referenced within them. If you do not agree with these Terms, please do not use the Services.

You represent that you are the age of majority in your province, state or territory of residence, or that you are accessing the Services with the permission of a parent or legal guardian where required. We reserve the right to refuse service, cancel orders or restrict access to the Services where reasonably necessary, including in cases involving suspected fraud, abuse, unauthorized commercial activity or violation of these Terms.

Changes to These Terms

We may update or modify these Terms & Conditions from time to time to reflect changes to our products, Services, business practices or legal requirements. Updates become effective when posted to the website unless otherwise stated.

The “Last Updated” date at the top of this page indicates when these Terms were most recently revised. Your continued use of the Services following an update constitutes acceptance of the revised Terms.

Privacy

Your use of the Services may involve providing personal information to Grip For You. Our collection, use, storage and disclosure of personal information is described separately in our Privacy Policy.

By using the Services, you acknowledge that certain information may also be processed by third-party platforms that help us operate our website, process payments, fulfill orders, communicate with customers, analyze website activity or provide advertising and marketing services.

Product Information

Grip For You makes reasonable efforts to accurately describe and display its products. However, photographs, renders, illustrations, prototypes, measurements, colours, materials, textures, finishes and other product representations are provided for general reference and may not exactly represent the final physical product.

Actual products may vary slightly because of manufacturing methods, materials, production tolerances, lighting, photography, rendering, screen settings, finishing methods or product revisions. Colours displayed on a computer, phone or tablet may also differ from the physical colour of a product.

Measurements and dimensions are approximate unless specifically stated otherwise. Grip For You may make reasonable updates or improvements to a product without updating every previously published photograph, render or description.

Small-Batch and Prototype Products

Certain Grip For You products may be designed, manufactured, assembled, finished or produced in small quantities. Because of this process, minor variations between individual products may occur.

These variations can include subtle differences in texture, surface finish, layer appearance, colour, dimensions, alignment or markings. Minor differences that do not materially affect the intended function of the product are not necessarily considered defects.

Products identified as prototypes, development products, experimental designs or samples may differ in appearance or construction from later production versions.

Product Compatibility

Customers are responsible for determining whether a Grip For You product is appropriate for their particular phone, phone case, device, surface or intended use.

Compatibility can depend on the phone model, case dimensions, case material, surface coating, attachment method, accessory placement, wireless charging configuration and other factors outside our control. A product that performs as intended with one device or case may perform differently with another.

Unless expressly stated otherwise, Grip For You does not guarantee universal compatibility with all phones, cases, chargers, mounts, accessories or surfaces.

Phone Grip Use

Grip For You products are accessories intended to assist with holding, handling, displaying or personalizing compatible devices. They are not safety devices and do not guarantee that a phone or other device cannot be dropped, damaged, lost or stolen.

Customers remain responsible for safely handling their devices at all times. Do not rely solely on a Grip For You product in circumstances where dropping a device could result in injury, property damage or significant loss.

Products should be inspected periodically. Discontinue use if you notice cracking, excessive wear, deformation, loosening, separation, damaged components or any other condition that may affect the product's performance.

Attachment Systems

Grip For You products may use adhesive, suction, magnetic, mechanical, removable or other attachment systems. Attachment performance can vary depending on surface material, coating, cleanliness, temperature, installation method, frequency of removal, age and general product condition.

Customers should follow any product-specific installation instructions and ensure that surfaces are clean, dry and appropriate for the attachment method before installation.

Certain textured, flexible, silicone, uneven or specially coated phone cases may reduce adhesion or attachment strength. Removing an accessory may also affect certain coatings, films, decals, finishes or cases.

Grip For You cannot guarantee identical attachment performance on every phone, case or surface.

Magnetic Products

Certain Grip For You products may contain magnets. Magnets can interfere with some electronics, cards, sensors, storage media, accessories, medical devices and other objects that are sensitive to magnetic fields.

Customers are responsible for keeping magnetic products away from objects that may be adversely affected. If you use an implanted medical device or other medical equipment that may be affected by magnets, follow the manufacturer's recommendations and obtain appropriate professional guidance regarding safe use.

Grip For You does not represent that magnetic products are compatible with every device, charging system, accessory, card or piece of electronic equipment.

Pricing

Prices displayed through the Services are shown in the currency identified on the website or at checkout and may change without prior notice.

Unless otherwise stated, displayed prices may not include applicable taxes, shipping charges, duties, customs charges, brokerage fees or other amounts that may apply to an order.

We reserve the right to correct pricing errors. If an incorrect price is displayed because of a technical, administrative or other error, we may cancel the affected order and refund any amount already paid.

Payment

Customers agree to provide current, complete and accurate billing, payment and contact information when placing an order.

Payments may be processed by third-party payment providers. Your use of those payment methods may also be governed by the provider's own terms and policies. Grip For You may not directly receive or store your complete payment card information.

Payment authorization does not necessarily constitute acceptance of an order. We may request additional information or verification before fulfilling an order where reasonably necessary.

Orders

Submitting an order through the website constitutes an offer to purchase the selected products. An order confirmation means that we have received the order but does not necessarily mean that the order has been accepted, produced or shipped.

Orders remain subject to product availability, payment verification, fraud screening, pricing verification and our ability to fulfill the order. We reserve the right to refuse or cancel an order where reasonably necessary.

An order may be cancelled because of incorrect pricing, inventory errors, payment failure, suspected fraud, inaccurate customer information, production limitations, misuse of promotional offers or violations of these Terms.

If an order is cancelled after payment has been collected, the applicable amount will be refunded to the original payment method, subject to the processing times of the payment provider.

Product Availability

All products are subject to availability. Certain products, colours, shapes, materials or collections may be released in limited quantities and may not be reproduced once sold out.

We may limit quantities, modify products, update designs, change colours or materials, revise manufacturing methods or discontinue products at any time.

Displaying a product on the website does not guarantee that it will remain available.

Custom Orders and Collaborations

Grip For You may offer custom products and collaborative projects for individuals, artists, designers, creators, businesses, brands, agencies, organizations or other customers.

Custom services may involve modifications to colour, graphics, logos, typography, branding, shape, product details, dimensions, packaging, attachment methods or quantities. Custom work may be subject to separate pricing, deposits, production requirements, approvals, minimum quantities and project-specific timelines.

Any quotation, invoice, purchase order, email approval, design approval or other written project agreement may form part of the agreement between the customer and Grip For You. Where project-specific written terms conflict with these general Terms & Conditions, the project-specific terms will generally control for that particular project.

Custom Design Approval

Customers are responsible for reviewing custom designs, proofs, renders, samples, specifications and other materials before approving production.

Approval may be provided through email, text message, electronic communication, invoice payment or another method accepted by Grip For You. Once approval has been given and production has started, changes may not be possible.

Changes requested after approval may result in additional design fees, manufacturing costs, material charges or production delays. Grip For You is not responsible for errors that were visible in an approved proof, render, design, sample or specification before production began.

Custom Colours and Materials

Digital colour references, photographs, renders and screen previews are intended to communicate an approximate colour direction unless a specific colour-matching process has been agreed upon separately.

Physical materials may reproduce colours differently from digital screens, and different materials may produce different results even when the same digital colour value is used.

Minor variation between materials or production batches may occur. Unless expressly agreed in writing, exact Pantone, photograph-to-product, render-to-product, screen-to-product or sample-to-product colour matching is not guaranteed.

Customer-Supplied Artwork

If you provide Grip For You with a logo, photograph, trademark, graphic, design, name, artwork, text or other material for use in a custom product, you represent that you have the rights, licences, permissions or authorization necessary to use and reproduce that material for the requested purpose.

You are responsible for ensuring that customer-supplied material does not infringe the intellectual property, privacy, publicity, contractual or other rights of another person or organization.

Grip For You may refuse to reproduce material that we reasonably believe may be unlawful, infringing or likely to expose Grip For You to unnecessary legal risk.

Samples and Prototypes

Samples and prototypes may be created during the development of certain custom products. These are intended to help evaluate general design direction, proportions, shape, colour, branding, construction or function.

Unless expressly agreed otherwise, a prototype does not guarantee that every final-production unit will be identical in every respect. Materials, internal structures, manufacturing methods, finishing details and other characteristics may be reasonably adjusted between prototype and final production.

Production Timelines

Production and completion dates provided by Grip For You are estimates unless a specific date is expressly guaranteed in writing.

Timelines may be affected by design revisions, customer approval delays, order quantities, equipment availability, material availability, suppliers, manufacturing issues, shipping carriers, customs, holidays, weather and other circumstances outside our reasonable control.

We will make reasonable efforts to complete accepted projects within estimated timelines but cannot guarantee a specific completion or delivery date unless expressly agreed in writing.

Shipping

Processing and production time is separate from shipping transit time. Delivery estimates shown through the Services or provided by shipping carriers are estimates and are not guarantees by Grip For You.

Customers are responsible for providing a complete and accurate shipping address. Grip For You is not responsible for delays or additional expenses caused by incorrect or incomplete information supplied by the customer.

Once an order has been transferred to a shipping carrier, delivery may be affected by carrier delays, weather, customs, holidays, address problems or other circumstances outside our reasonable control.

If a package is returned because of an incorrect address, failed delivery, refusal or similar issue, additional shipping charges may apply before the order is resent.

International Orders

International orders may be subject to customs charges, import taxes, duties, brokerage fees and other amounts imposed by local authorities or carriers.

Unless expressly included at checkout, these charges are the responsibility of the customer. Customers are also responsible for determining whether products may legally be imported into their destination.

Grip For You is not responsible for delays resulting from customs processing or for duties, taxes, brokerage fees or return costs resulting from a customer's refusal or failure to accept an international shipment.

Lost, Stolen or Damaged Shipments

We may request additional information reasonably necessary to evaluate the claim. Where appropriate and subject to applicable law, Grip For You may offer a repair, replacement, store credit, partial refund, full refund or another reasonable resolution.

Normal wear, accidental damage, improper installation, misuse, incompatible phones or cases, modifications after delivery or ordinary cosmetic wear are not necessarily considered manufacturing defects.

Order Cancellations

Orders may begin processing shortly after they are submitted. We therefore cannot guarantee that an order can be cancelled once it has been placed.

Custom orders may not be cancellable after design, material purchasing, manufacturing, printing, finishing or other production activity has begun.

Where a cancellation request is received before work begins, Grip For You may determine whether cancellation is possible based on the circumstances of the order.

Intellectual Property

Unless otherwise stated, the Grip For You and GripForYou names, product designs, shapes, branding, logos, graphics, photographs, renders, videos, website content, text, packaging concepts, artwork and other original materials created by Grip For You are owned by or licensed to Grip For You.

These materials may be protected by copyright, trademark, industrial design, trade dress and other intellectual property laws. Purchasing a Grip For You product does not transfer ownership of Grip For You intellectual property to the customer.

Except where permitted by law or expressly authorized by Grip For You, you may not reproduce, manufacture, modify, distribute, sell, commercially exploit, license or create derivative commercial products based on Grip For You proprietary designs or materials.

Website Use

Grip For You grants users a limited, revocable, non-exclusive and non-transferable right to access and use the Services for lawful personal or commercial purchasing purposes.

You may not misuse the website, interfere with its operation, attempt unauthorized access, distribute malicious software, collect information unlawfully, impersonate another person, circumvent security features, infringe intellectual property rights or use the Services for unlawful purposes.

Automated purchasing systems, bots, scripts, spiders, scraping tools or similar technologies may not be used in a way that interferes with normal website operation, product availability or purchasing limits.

Social Media and User Content

If you tag Grip For You, mention us, send photographs, provide testimonials or otherwise voluntarily submit content, we may contact you to request permission to use or repost that content.

Submitting material to us does not automatically transfer ownership of your content except where expressly agreed. Any marketing use may be subject to the specific permission or licence granted by you.

Third-Party Services

The Services may include links to or integrations with payment providers, shipping companies, social networks, analytics providers, websites, applications and other services operated by third parties.

Grip For You does not control those third parties and is not responsible for their availability, content, security, policies or business practices. Your use of third-party services may be governed by separate terms and privacy policies.

Website Availability

Grip For You aims to keep its website accurate and available but does not guarantee uninterrupted access.

The website may occasionally be unavailable because of maintenance, updates, technical issues, security concerns, outages or circumstances outside our reasonable control.

We may modify, replace, suspend or discontinue any part of the Services at any time, subject to applicable law.

Errors and Inaccuracies

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, photographs, promotions, availability, shipping charges, delivery estimates or other information.

Grip For You reserves the right to correct errors, update information and cancel affected orders where reasonably necessary, including after an order has been submitted.

To the extent permitted by applicable law, you agree to indemnify and hold Grip For You and its owners, employees, contractors, service providers and representatives harmless from reasonable claims, losses, liabilities, costs and expenses resulting from your unlawful use of the Services, violation of these Terms or customer-supplied material that infringes another party's rights.

This provision does not apply to the extent that a claim results from conduct for which Grip For You is legally responsible and liability cannot lawfully be excluded.

Fraud and Abuse

Grip For You may investigate suspected fraudulent, abusive, unauthorized or unlawful activity.

Where reasonably necessary, we may cancel orders, restrict transactions, limit quantities, refuse future transactions, suspend access or provide relevant information to payment providers or appropriate authorities as permitted by law.

Promotions

Promotional offers, discount codes, giveaways, credits and limited-time offers may be subject to additional terms.

Unless otherwise stated, promotions cannot be combined, transferred, exchanged for cash or applied retroactively to completed purchases.

We may cancel or correct promotional offers that contain errors or are being used fraudulently or contrary to their stated terms.

Force Majeure

Grip For You will not be responsible for delays or failure to perform caused by circumstances outside our reasonable control.

These circumstances may include severe weather, natural disasters, fire, flood, transportation interruptions, labour disruptions, equipment failures, power failures, material shortages, supplier issues, government actions, telecommunications outages, cyber incidents or public emergencies.

Where possible, we will make reasonable efforts to resume affected operations.

Governing Law

These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles, except where mandatory consumer protection laws provide otherwise.

Subject to rights that cannot legally be waived, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of Ontario, Canada.

Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in full force and effect.

No Waiver

Grip For You's decision not to immediately enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver relating to one situation does not constitute a waiver relating to another situation or future violation.

Entire Agreement

These Terms & Conditions, together with our Privacy Policy, product-specific policies, return policies and any written terms applicable to a particular custom project, constitute the agreement between you and Grip For You regarding the applicable Services.

A separately agreed quotation, invoice, purchase order, collaboration agreement or custom-production agreement may supplement or replace portions of these Terms for that particular transaction.

Changes to Products and Services

Grip For You may modify, improve, redesign, replace or discontinue products and Services at any time.

Product development is an ongoing process, and products may evolve between collections and production runs. We are not obligated to continue producing a particular shape, colour, design, material, attachment method or collection indefinitely.
